Terms of Service

1. Introduction
These Terms of Service ("Terms") govern your use of the Tellux platform and services. By registering for an account or using the service, you agree to these Terms. If you do not agree, you must not use the service.
Tellux is a UK-based service providing planning application intelligence and lead generation tools for the construction industry.
2. Definitions
- "Service" means the Tellux web application and all associated features.
- "User" means any person or entity that registers for an account.
- "Content" means planning application data, letters, templates, and other material available through the service.
- "Subscription" means the recurring fee paid for access to the service.
3. Account registration
To use the service, you must register for an account. You agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
You must be at least 18 years old to use the service.
4. Subscriptions and billing
Subscription fees are charged monthly in advance. Your subscription will auto-renew unless cancelled before the next billing date. All prices are in GBP and exclude VAT where applicable.
Cancellation:
You may cancel your subscription at any time. Upon cancellation, your access will continue until the end of the current billing period. No pro-rata refunds are given for partial months.
Consumer right to cancel (14-day cooling-off period):
If you are a consumer (not a business), you have the right to cancel within 14 days of signing up and receive a full refund, as set out in the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
5. Use of the service
You agree to use the service only for lawful purposes and in accordance with these Terms. Specifically, you must not:
- Use the service for any unlawful purpose or in violation of any UK regulation
- Attempt to access, scrape, or extract data from the platform beyond normal use
- Use the service to send unsolicited communications (spam)
- Share your account credentials with unauthorised users
- Reverse-engineer, decompile, or tamper with the platform
6. Data and content
Planning application data displayed on Tellux is sourced from UK local authority planning portals via third-party APIs. While we strive for accuracy, we do not guarantee that the data is complete, current, or error-free. You should verify critical information through the relevant council portal.
You retain ownership of any letter templates, letters, and content you create within the service. You grant us a licence to store and process this content solely for the purpose of providing the service.
7. Limitation of liability
The service is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by UK law:
- We are not liable for any indirect, incidental, or consequential damages arising from your use of the service.
- Our total liability to you shall not exceed the total amount paid by you in the 12 months preceding the claim.
- We are not responsible for any loss of business, contracts, or revenue resulting from your use or inability to use the service.
Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded under UK law.
8. Intellectual property
The Tellux platform, including its design, code, branding, and proprietary features, is owned by Tellux and protected by UK and international intellectual property laws. You may not copy, modify, distribute, or create derivative works without our express written permission.
9. Termination
We may suspend or terminate your account if you breach these Terms or engage in activity that harms the platform or other users. Upon termination, your access to the service will cease and your data will be deleted in accordance with our Privacy Policy.
You may terminate your account at any time by contacting us. We will process the deletion of your data within 30 days.
10. Governing law
These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
11. Changes to these Terms
We may update these Terms from time to time. We will notify you of material changes by email or through the platform. Continued use of the service after changes constitute acceptance of the new Terms.
